Terms of Service
These Terms of Service ("Terms") govern your use of Clarinet ("the Service"), provided by Obanek Labs ("we", "us", "our"). By creating an account or using the Clarinet API, you agree to these Terms.
1. The Service
Clarinet is a cognitive load optimization platform. It analyzes task descriptions and suggests execution orders using deterministic heuristics and, optionally, large language models. Clarinet is a decision support tool, not medical, psychological, psychiatric, or clinical advice.
2. Account
- You must be at least 16 years old. Under 16 requires parental consent.
- You are responsible for safeguarding your password. Notify us immediately of unauthorized access.
- One account per person. Sharing accounts is not permitted on paid plans.
- Provide accurate information. Impersonation or fraudulent signup results in account termination without refund.
3. Acceptable Use
You agree not to:
- Use Clarinet for illegal or harmful purposes
- Submit content that violates third-party rights (copyright, privacy, confidentiality)
- Reverse-engineer the engine, scrape at scale, or probe security
- Use Clarinet to harass, discriminate, or generate harmful content
- Resell or redistribute access without our written consent
- Abuse rate limits or attempt to overwhelm our infrastructure
4. Plans and Pricing
- Free: heuristic engine, 20 tasks per plan
- Personal €4.99/mo: full features for individuals
- Team €99/mo per team: admin dashboard, team analytics
- Enterprise: custom pricing, SSO, on-premise option
Prices are in EUR and exclude VAT where applicable. Billing recurs monthly or yearly. Cancel anytime via the customer portal; access continues until the end of the current billing period.
5. Your Content
You retain ownership of all task descriptions and data you submit. You grant us a limited license to process this data solely to provide the Service. We do not use your data to train models, sell it, or share it with advertisers.
6. Our Intellectual Property
Clarinet, including the heuristic engine, scoring algorithms, seed data (verb taxonomy, transition matrix), source code, logos, and content, is owned by Obanek Labs and protected by copyright. "Clarinet" is a trademark of Obanek Labs.
7. Third Party Services
When you enable the optional LLM dual engine, task descriptions are transmitted to the selected provider (Anthropic or OpenAI). PII-like patterns are redacted before transmission, but you remain responsible for not submitting sensitive data through this mode.
8. Availability and Changes
We aim for high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features at any time. Material changes affecting paid plans will be announced at least 30 days in advance.
9. Limitation of Liability
To the maximum extent permitted by law, Obanek Labs shall not be liable for indirect, incidental, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from your use of Clarinet. Our total liability shall not exceed the fees you paid in the 12 months preceding the claim.
Clarinet is a decision support tool, not a medical device. We are not liable for decisions you make based on its output.
10. Warranty Disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that Clarinet will meet your specific requirements, be error-free, or be available at any particular time.
11. Termination
You may delete your account at any time through the account settings or by emailing hello@obaneklabs.com. We may suspend or terminate accounts for violations of these Terms, with or without notice, in our reasonable discretion.
12. Governing Law and Venue
These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict of law rules and the UN Convention on Contracts for the International Sale of Goods. For consumers resident in the EU, mandatory consumer protection laws of your country of residence apply in addition.
Exclusive venue for disputes with business customers is Berlin, Germany, to the extent permitted by law.
13. Changes to These Terms
We version these Terms. Material changes are announced by email and require re-acceptance before the next login. Continued use after re-acceptance constitutes agreement.
